Terms and Conditions
1. Reservations and Payments
A reservation becomes binding:
once confirmed by email or through the booking system, or
once a deposit or full payment is received (all payments are non-refundable).
Payment methods:
online card payment,
bank transfer to a Czech bank account (treated as a payment made in favour of Blue Whale Lodge Lanka PVT Ltd).
Bank fees are paid by the guest.
Prices become binding once the reservation is confirmed.
2. Meals and Allergies
We prepare a single menu for all guests.
Meals must be ordered in advance, because:
we purchase fresh ingredients daily,
traditional recipes require approx. 3 hours of preparation,
we aim to minimise food waste.
Guests must inform us of any allergies in advance.
If we are informed of an allergy:
we will prepare an alternative meal without the allergen, or
we will inform the guest which meal contains the reported allergen.
We are not responsible for reactions caused by allergies that were not reported in advance.
3. Check-in / Check-out
Check-in: 14:00–20:00
Check-out: 10:00
Other times available upon agreement and subject to availability.
4. Rates, Cancellation Policy and Children
Flexible Rate
Cancellation free of charge at any time
Date changes free of charge (subject to availability)
Non-refundable Rate
Payment at the time of booking is non-refundable
One date change allowed if requested at least 1 month before arrival
Fair-use rule (voluntary)
If the guest cancels early and we successfully resell the cancelled dates,
we will refund a proportional amount for the nights that were re-sold.
This is a voluntary benefit, not a guaranteed right.
No-show
100% cancellation fee according to the selected rate.
Children
Children under 10 years stay and eat free of charge
(tours and activities are charged separately)Children 10+ years are charged as adults
5. Guest Responsibility
Guests are responsible for:
any damage to room equipment, linens, towels, mattresses, the garden or the pool area,
safe use of the pool, waterslide, waterfall, net, and adjacent areas,
respecting the no-glass rule in the pool area,
not disturbing other guests (including when using the BBQ; the grill must be returned clean),
supervising children at all times.
Towels
White towels are for indoor use only
Pool towels are provided for pool use
Beach mats are provided for the beach (towels are not allowed on the beach)
Damage caused by creams, make-up or dyes will be charged to the guest
6. Limitation of Liability
6.1 Liability cap
The maximum liability of Dune Towers is 50% of the total accommodation price,
unless damage was caused intentionally or by gross negligence.
6.2 Exclusions of liability
Dune Towers is not liable for:
Loss or damage to property
luggage, personal belongings, valuables or electronics,
including items stored in the room or the room safe.
Injuries or health issues, including those caused by:
slipping,
the pool, waterslide or waterfall,
natural elements such as falling coconuts, branches or trees,
waves, currents, sea conditions or animals,
insects (including sand flies),
heat, sun exposure or weather conditions.
Events beyond the resort’s control, such as:
power or water outages,
equipment or transport failures,
unrest, strikes, terrorism, natural disasters or severe weather.
7. External Tours and Activities
Safari trips, dolphin watching, diving and other activities are provided by independent licensed partners.
Dune Towers is not the organiser and is not responsible for their safety, quality or cancellation conditions.
8. Unused Services
Unused parts of the stay or unused services are non-refundable.
9. Complaints
Please report any issues during your stay.
Complaints after departure can be submitted by email within 14 days.
10. Personal Data
Guest data is used solely for reservation processing and legal obligations.
11. Governing Law
The contractual relationship is governed by the laws of Sri Lanka.
Validity
The above terms and condition are valid from the 1st of October 2025.
